Does my Spouse Get Automatic Citizenship When I Do?

This is a question we are often asked at Luxembourg Legacy. It would be wonderful if your spouse did get citizenship when you did, but they do not.

Luxembourg dual citizenship is based on reclaiming it from an ancestor who had Luxembourg citizenship. Thus, you can reclaim your ancestor’s Luxembourg citizenship and so can your children, grandchildren, etc, but your spouse cannot since they do not have direct-line descendancy from your ancestor. But there is some good news!

When you get citizenship, your spouse will be added to your entry on the National Registry database in the marital status section. You will be listed as married and your spouse’s name and your marriage date/place will also be listed. Your spouse is not a citizen but by being listed with you on the National Registry, they gain the right to live, study, work or retire in the European Union.

What a smart move it was for your spouse to marry you!

Please tell us more about the rights the spouse receives in the EU. My husband is on page 2 of my passport and we are curious how this plays into applying for residency in an EU country and/or if we stay in the EU longer than a visitor VISA, does he have the right to stay as long as I do without leaving? Any additional insight is much appreciated.
