Article 23

Working Through a Parent or Grandparent

Article 23 allows individuals to base their citizenship on qualifying parents or grandparents. Once ancestry has been proven, you can apply with a quick easy trip to Luxembourg.

Who Qualifies?*

1. Anyone with with a parent or grandparent who is or was a Luxembourg citizen

2. Anyone with a parent or grandparent who qualifies (or would have qualified, if they are deceased) for Article 7 (i.e., they had an all-male lineage back to Luxembourg)

Minors (children under 18) are included on their parents’ applications.

NOTE: Family applications can “stack” – if you are an adult with a great-grandmother who had an all-male lineage, your parent can apply first. Once they become a citizen, you can start your application based on your parent.

Frequently Asked Questions

Do they speak English in Luxembourg?

Yes, you will have no trouble communicating during your trip to Luxembourg to turn in your paperwork. They speak excellent English.

Do minors need to travel to Luxembourg?

No, children under 18 do not need to accompany their parents on the Stage 2 trip to Luxembourg.

Will you order all of my documents for me?

In the United States, only family members can order these records, but we will provide details guidance on how to order them, along with instructions on how to proceed when records are missing. We can order your records from Luxembourg, though, as long as they are from more than 100 years ago.

Is there a deadline?

No, there is currently no deadline for Article 23. However, the law can always change, so we recommend acting quickly to take advantage of this opportunity.

Will my spouse get citizenship with me? What about a same-sex spouse?

Spouses (of any sex) do not gain citizenship with you, but they do gain the right to live/study/work/retire in Europe alongside you.

What if I'm adopted?

If you were legally adopted into a family of Luxembourgish descent, you may still be eligible for citizenship. However, you will need to do additional work to prove the adoption was legitimate – either obtain a Hague certificate, or complete an exequatur process. Reach out for more information.

If you were adopted out of a Luxembourgish family, you are unfortunately no longer eligible to reclaim citizenship.

What if I no longer identify as the sex I was assigned at birth?

Luxembourg is very progressive – just make sure that your paperwork is all consistent. For example, if your passport indicates that you are male, you should have your birth certificate amended to match.

What is the deal with the year 1969?

In 1969 the Luxembourg government changed their laws to allow women to pass on citizenship eligibility to their children at birth. That means anyone born after January 1, 1969 to a woman who qualified for Article 7 also qualifies for Article 7 – even though their lineage is not all-male.
